Sourcepole AG, Weberstrasse 5, CH-8004 Zürich (hereinafter the "Service Provider") makes products, software, and services available at *.qgiscloud.com, *.qgiscloud.ch, and other top-level domains (hereinafter referred to as "QGIS Cloud" or the "Services"). By using these Services, you agree to these General Terms and Conditions (hereinafter "GTC"). The Service Provider reserves the right to change the GTC at any time without notice. If any provision of these GTC is or becomes invalid, the validity of the remaining provisions remains unaffected. The Service Provider reserves all copyrights and other rights to QGIS Cloud. You must not remove, cover, or alter legal notices (such as copyright or trademark notices). You must not use the trademarks of QGIS Cloud (in particular QGIS Cloud) for your own purposes of any kind. If you violate these provisions, you will forfeit your right to use the Services, and the Service Provider will be entitled to close your account or block access to the Services. These Terms constitute the entire agreement between you and the Service Provider and replace all prior agreements on this subject. Verbal agreements are invalid. The Terms apply in every case in accordance with Swiss law, regardless of your location. The competent court of jurisdiction is at the registered office of the Service Provider.

Performance by the Service Provider

The Service Provider does not guarantee that (i) the Services will meet your requirements or expectations, (ii) the Services will be continuous, reliable, and error-free, (iii) the results you receive through use of the Services will be correct and reliable, or (iv) possible errors in the Services will be corrected. The Service Provider is not responsible for direct or indirect damage of any kind resulting from: (i) the use of and/or inability to use the Services, (ii) changes to the Services, (iii) permanent or temporary non-availability of the Services, (iv) non-availability of correct data processed by the Services, or (v) any other cause in connection with the Services. The Service Provider offers technical support on a "best efforts" basis and exclusively via e-mail. The Service Provider does not guarantee the availability of technical support. The Service Provider has the right to use third parties to provide any of the Services at any time. The Service Provider has the right to discontinue the Services (or any part thereof) permanently or temporarily at any time, or to remove, change, or add Services. Changes are automatically subject to these provisions. By continuing to use the Services after such changes, you tacitly agree to the changes.

Your Use of the Services

You agree to use the Services only in accordance with (i) the terms contained herein and (ii) the laws and regulations applicable to you. For some Services (or portions thereof), the Service Provider may require you to register for an account. During registration, you must provide all required information correctly and truthfully, and you must keep it up to date. You are also responsible for the security of your password. It is not permissible to create accounts automatically. You agree not to intentionally disrupt the Services in any manner. You agree not to reproduce the Services for any purpose, or to copy, sell, trade, or redistribute them. You must agree to the privacy policy of the Service Provider. The Service Provider reserves the right (but is not obligated) to review content or Services within accounts, or to filter, modify, reject, or delete them. You acknowledge that you must not publish data through QGIS Cloud that is offensive, indecent, or otherwise objectionable.

Advertising

QGIS Cloud Free is financed by advertising and/or other promotional measures. The display of these advertisements can be controlled by information arising from the use of the Services. The nature and extent of advertising can change at any time. You agree that QGIS Cloud displays advertising. If you use a free Service, you must not block the ads.

API

The use of the API ("application programming interface") is subject to these Terms and Conditions and the following specific provisions: Excessive use or abuse of the API can result in temporary or permanent blocking of access to the API. The Service Provider alone decides when use is unreasonable or excessive. The Service Provider reserves the right to change your access to the API at any time, or to discontinue it temporarily or permanently. In particular, the Service Provider reserves the right to limit the number of requests and transactions per time unit. The Service Provider may inform you of any such change or adjustment. The Service Provider reserves the right to convert the API into a paid service and to charge for some or all requests and transactions. In this case, you, as a user of the API, are free to stop using the API or to continue using it for a fee.

Purpose

The Service Provider provides its website qgiscloud.com to its registered members as a publishing system (platform) for publishing Web Map Services on the Internet. Members can autonomously and responsibly offer maps on qgiscloud.com. The members are responsible for the content of the maps. The Service Provider, its agents, employees, and auxiliary persons are not responsible in any way for the content of the information published by members' maps. Sourcepole AG shall not be liable for any damages resulting from publication. The Service Provider is not obliged to check the behavior of its members in connection with the use of qgiscloud.com. In particular, the Service Provider is entitled, but not obliged, to check maps published by its members on qgiscloud.com for legality or otherwise admissibility in any way.

Subscriptions

QGIS Cloud Pro

The use of QGIS Cloud Pro is subject to these Terms and Conditions as well as the following specific provisions. QGIS Cloud Pro is charged monthly. Upgrades can be made at any time and are effective immediately. Any refund is excluded. Reimbursement is explicitly excluded in the following cases: failure of Services during the subscription period, downgrade, partial use of the Services, or change of the functional scope.

QGIS Cloud Free

The use of QGIS Cloud Free is subject to these Terms and Conditions as well as the following specific provisions. QGIS Cloud Free is an online service for non-commercial and non-governmental use only. Private use of QGIS Cloud Free, as well as use for training and education, is encouraged. A QGIS Cloud Pro account is required for commercial or governmental use. Overuse or misuse of QGIS Cloud Free may result in temporary or permanent blocking of access. The Service Provider alone decides when use is unreasonable or excessive. The Service Provider reserves the right to terminate a QGIS Cloud Free account permanently or temporarily and delete the stored data if these rules are violated. The Service Provider also reserves the right to periodically remove inactive QGIS Cloud Free accounts and their associated data. An account may be considered inactive based on factors such as the time since the last login and the usage of published maps. The Service Provider alone decides when a violation has occurred. If an account is blocked, the Service Provider will notify the account owner of the lockout by e-mail. The Service Provider always communicates via the e-mail address associated with the QGIS Cloud Free account.

Subscription Period and Billing

The paid Services are automatically charged monthly to the member's account and run until the subscription is terminated.

Termination of QGIS Cloud Subscriptions

The QGIS Cloud subscription can be terminated at any time and runs until the end of the paid period.

Prices

The Service Provider reserves the right to change the prices of all Services at any time. Price changes will be communicated by e-mail at least one month before they take effect. The Service Provider cannot be held responsible to you or any third party for price changes or any consequences resulting from price changes.

Changes

The Service Provider has the right to change these Terms at any time.
